City Abates Nuisance

On November 30, 2015, City crews enforced a court order to remove items that were previously declared a nuisance by the court. City departments removed, from 25 3rd Street N.W., three truck-loads of debris, garbage and junk from the front, sides and back yard of the property as well as drained dark and stagnant water from a large above-ground swimming pool.

On November 10, 2015, evidence was provided to the court that displayed that officers had attempted to gain compliance, from the property owner, for several months.  The court declared the items listed on the property were a nuisance, as defined in the Oelwein City Code, and ordered the property owner to remediate the issues.  The court assessed a fine of $5,000 towards the property owner.  Of that fine, $4,000 would be suspended if the property owner removed the nuisances prior to November 27th.  If the items were not removed, the court authorized the City of Oelwein to remove the items and assess the costs to the property owner.

On November 30th, it was determined that the nuisance had not been abated and the City of Oelwein took the appropriate steps to remove the nuisances.
